Patentability / Novelty Search

Patentability searches are typically performed before applying for a patent to assure an invention is patentable.

A patentability/novelty search examines granted and published applications of major patent offices as well as domain-relevant non-patent literature. You will receive a concise search report containing citations to sections of any prior art found and electronic copies of the referenced documents.

Coverage and Outcomes

  • The search scope includes patents and non-patent literature sources in the United States, Europe, Asia, and other WIPO PCT countries. Other sources may be searched upon request.
  • The result of a patentability search is to exhaustively identify art published prior to an invention and to provide documentation with citations and excerpts from the found references.

Specifications Needed

  • A paragraph or single page description of the invention with the novel steps clearly delineated; drawings are often helpful. -or-
  • A provisional or patent application draft, with the primary inventive steps (that is, the embodiment or claims that are the focus of the search) clearly delineated. -or-
  • For a pharmacutical or industrial chemical search, a document with the novel structure(s) and/or compound(s) and/or composition(s).
